INFORMATION DUTY PURSUANT TO ART. 13 GDPR

Information provided when collecting data from the data subject

Pursuant to Art. 13(1) and (2) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, hereinafter “GDPR”), we inform you that:

  • the controller of your personal data is Sławomir Kowalik, conducting business under the name NZOZ Dental Art, with its registered office at ul. Komandorska 53a/3b, 53-342 Wrocław (hereinafter the “Controller”),
  • the Data Protection Officer for the Controller is available at tel.: 71 373-22-66 or via email: iod@dental-art.pl
  • your personal data will be processed:
  1. on the basis of Art. 23 et seq. of the Act of 6 November 2008 on Patients’ Rights and the Patient Ombudsman, and
  2. for the purpose of documenting your state of health and the healthcare services provided to you,

and therefore the recipients of your personal data may include persons and entities indicated in Art. 26 of the Act of 6 November 2008 on Patients’ Rights and the Patient Ombudsman, as well as in provisions of specific statutes,

  • where healthcare services are financed from public funds, your personal data will be processed:
  1. on the basis of Art. 2 and Art. 49 et seq. of the Act of 27 August 2004 on Healthcare Services Financed from Public Funds, and in the cases referred to in Art. 12 et seq. of that Act — on the basis of those specific provisions, and
  2. for the purposes of verifying your entitlement to publicly funded healthcare services, as well as for settlement purposes with the National Health Fund or another financing entity,
  • your personal data will not be transferred to third countries/ international organisations,

If there is a need to transfer information to third countries or international organisations, you will be informed of this fact separately.

  • your personal data will be stored for the periods specified in Art. 29 of the Act of 6 November 2008 on Patients’ Rights and the Patient Ombudsman and in specific provisions (e.g. the Regulation of the Minister of Health of 9 November 2015 on the types, scope and templates of medical documentation and the manner of its processing),
  • you have the right to access your data and to rectify, erase, or restrict processing, the right to data portability, the right to object to processing, and the right to withdraw consent at any time without affecting the lawfulness of processing based on consent before its withdrawal, subject however to the rules on collecting and processing data in medical documentation set out in Chapter 7 of the Act of 6 November 2008 on Patients’ Rights and the Patient Ombudsman and in specific provisions,
  • if the data protection provisions are breached, you have the right to lodge a complaint with the supervisory authority. The supervisory authority is the President of the Personal Data Protection Office (PUODO),
  • providing the personal data collected in medical documentation is mandatory for the purposes of healthcare,
  • your data are not subject to profiling,
  • your data are not processed by automated means.
